A significant part of the caseload of The Tyra Law Firm, P.C. is insurance coverage and insurance fraud investigation.
Kevin Tyra has represented several insurance carriers over the years in insurance-coverage matters, including uninsured and underinsured motorist cases, and coverage disputes over such issues as non-cooperation, non-compliance, permissive user, and suspected fraud. Kevin’s role may be to assist in the investigation and analysis of the claim, providing an opinion letter regarding coverage; and in other cases, representing the carrier in a declaratory judgment action regarding coverage decisions the carrier has already made.
As outside counsel, Kevin is acutely aware of the importance of giving the carrier his candid opinion about whether the carrier has a valid position, and then vigorously defending that position when Kevin and the carrier agree about the validity of the carrier’s position. Kevin has taken coverage cases to trial, defending the carrier’s decision to judgment.
Kevin assists Special Investigation Units of carriers, such as State Farm and MetLife, in investigating suspicious claims, including conducting examinations under oath and preparing opinion letters regarding coverage.
Kevin Tyra’s legal experience includes several years working as in-house counsel with an insurance carrier, gaining greater insight into the needs and interests of the claim professional to better serve the claim professional in coverage matters, including the importance of timely and effective reporting upon which the claim professional can make the best decisions regarding reserves and claim-handling strategy.
Kevin was the 2007-2009 chair of the Insurance Coverage Section of the Defense Trial Counsel of Indiana. Kevin also serves on the board of directors of the Indiana Chapter of the National Society of Professional Insurance Investigators. He is a frequent speaker on insurance coverage and insurance fraud issues before groups such as the Insurance Institute of Indiana, the Indiana Continuing Legal Education Forum, and the Defense Trial Counsel of Indiana.
