Insurance Coverage and Insurance Fraud Investigation

A significant part of the caseload of The Tyra Law Firm, P.C. is insurance coverage and insurance fraud investigation.

Kevin Tyra has represented several insurance carriers over the years in insurance-coverage matters, including uninsured and underinsured motorist cases, and coverage disputes over such issues as non-cooperation, non-compliance, permissive user, and fraud. Kevin’s role may be to assist in the investigation and analysis of the claim, providing an opinion letter regarding coverage; and in other cases, representing the carrier in a declaratory judgment action regarding coverage decisions the carrier has already made. Medical Malpractice and Nursing Home Defense

After several years practicing in general liability insurance defense, Kevin Tyra became in-house counsel for the claim department of Physicians Insurance Company of Indiana, which later became Medical Assurance of Indiana, and later part of ProAssurance. As in-house counsel, Kevin served as counsel of record on 93 cases without a loss, representing physicians, nurses, dentists, and practice groups. He also served as a claim examiner at PICI/MAI for many other files, gaining insight into the perspective of the claim professional, including the importance of setting accurate reserves and seeing both the positives and negatives of a case as early as possible. Worker’s Compensation Defense

The Tyra Law Firm, P.C. defends claims made against employers before the Worker’s Compensation Board of Indiana. This often entails investigation of the alleged work-related injurious incident, discovery as necessary for the individual claim, and defending the employer/carrier in trial-like hearings before the Board, as well as appeals to the Full Board and the appellate courts.

Our experience also includes representing the interests of the worker’s comp carrier in pursuing its lien against third parties liable for the worker’s injury.

Mediation and Arbitration Services

Kevin Tyra has been a registered civil and family mediator pursuant to the Indiana Alternative Dispute Resolution Rules since completing the prescribed training in 1995. He has maintained his registration through continuing mediator training, and has served as an assistant trainer for new mediation trainees. Kevin contributed the chapter on “Administrative ADR” to the Indiana Alternative Dispute Resolution Manual (Lawyer’s Co-op, 1995). He was the co-author of “Mediation Confidentiality: Myth and Misnomer?” (Indiana Civil Litigation Review, 2006). Read more
